ROBERT C. RAMIREZ: Probate is a process where we make certain decisions and disperse a decedent's estate, someone who's passed away. There are simple ways to do probate. And some lawyers don't necessarily think about those simple ways. They immediately go to the standard estate administration. But there are other ways to handle a probate estate.
Typically, when we talk about a complicated probate, we're either talking about someone who didn't leave a will and may have a lot of different heirs at law out there, a lot of people who might be eligible to receive from the decedent's estate. Or you have folks that are questioning the validity of the will or questioning whether or not that will was done under some kind of duress or under some type of other manipulation.
Most probate courts require that you have an attorney represent you in a probate case because you are acting as a fiduciary to the estate. And therefore, the courts require that. There are some exceptions, like a small estate administration. But typically, those just don't apply.
